The purpose of this page is to provide information regarding record retention policies, guidance, schedules and reference to laws, policies and schedules pertaining to Emergency Planning and Community Right-to-Know (EPCRA) public records.

Item No. M1-245, Tier II Emergency and Hazardous Chemical Inventory Reporting Forms, minimum retention required is 2 years.

- Federal Register, Volume 64, No 28., Thursday, February 11, 1999, Page 7045. Under section G, Paperwork Reduction Act it states there are no recordkeeping requirements for facilities under EPCRA sections 311 and 312.
- US Code, Title 42, Chapter 116, Section 11022. Emergency and hazardous chemical inventory forms, commonly referred to as Tier II.
- SERC or LEPC is required under federal law to respond to a request for Tier II information no later than 45 days after the date of receipt of the request.
Public Access to EPCRA Information
Any person who seeks to review or obtain copies of EPCRA records and/or information must submit a Request for EPCRA Information. The SERC Administrator will review requests to determine if the information is sensitive in nature or confidential, prior to releasing copies of the records and/or information. Forms must be signed and dated by the requestor. The SERC is not accepting any forms electronically at this time.
SERC members may inform requestors to send an email to the SERC at deep.ctepcra@ct.gov requesting such a form or inform them a copy of the PDF form is available through the SERC portal site under Forms or at https://www.ct.gov/serc/cwp/view.asp?a=2431&q=315298.
