     The above-captioned matter was scheduled to be heard as a contested case on July 16, 2012, at which time the complainant and the respondents appeared. 
     At the conclusion of the hearing, the parties informed the hearing officer that, prior to the issuance of the hearing officer’s report, they would like to continue working with a mediator in an attempt to settle this matter.  The parties’ request was granted.
     By letter dated and received July 20, 2012, the respondents informed the hearing officer that the parties had participated in a conference call with the mediator and had made significant progress towards a settlement with regard to the complainant’s request for records.  The respondents further informed the hearing officer that the mediator had scheduled a follow-up call for July 31, 2012.  Based on their progress in mediation, the parties requested that the hearing officer stay the issuance of the hearing officer’s report until August 3, 2012.  The parties’ request was granted. 
     On August 3, 2012, the complainant filed a withdrawal of his complaint in this matter.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
     1. Based on the withdrawal of the complaint, the case is hereby dismissed.
