     The above-captioned matter was consolidated for hearing with Docket # FIC
2010-173; David Taylor v. Executive Director, State of Connecticut, University of Connecticut Health Center, Correctional Managed Health Care, Osborn Correctional Institution; and State of Connecticut, University of Connecticut Health Center, Correctional Managed Health Care. Both matters were heard as contested cases on September 24, 2012, at which time the complainant and the respondents appeared and presented testimony on the above captioned complaint. The complainant, who is incarcerated, appeared via teleconference, pursuant to the January 2004 memorandum of understanding between the Commission and the Department of Correction, See Docket No. CV 03-0826293, Anthony Sinchak v. FOIC, et al., Superior Court, J.D., of Hartford at Hartford, Corrected Order dated January 27, 2004 (Sheldon, J.).
     At the hearing, the parties also expressed their desire to negotiate a resolution of both cases following the hearing.
     By letter dated September 21, 2012, but filed with the Commission on October 22, 2012, the complainant requested that both cases be withdrawn.
     The following orders by the Commission are hereby recommended on the basis of the record:
     1.  Based on the withdrawal of the complaint, the case is hereby dismissed.
     2.  The Commission commends the parties on having agreed to a settlement without full adjudication.
