The above-captioned matter was heard as contested case on January 12, 2012, at which time the complainant and the respondents appeared and presented testimony and argument on the complaint.

     On April 13, 2012, the complainant filed a letter with the Commission stating that: a) the respondents provided numerous records to the complainant on April 11, 2012; b) counsel for the respondents provided the complainant with assurance that the records disclosure was complete to the best of counsel’s knowledge; c) a search will continue and any additional records, which are identified within the scope of the request, will be provided to the complainant. Based upon these representations by counsel to the respondents, as set forth in the complainant’s letter, the complainant also requested that the case be withdrawn.

     The following orders by the Commission are hereby recommended on the basis of the record:

     1. Based on the withdrawal of the complaint, the case is hereby dismissed.

     2. The Commission commends the parties on having reached a settlement that may contribute to resolution of the disputes concerning various Fire Departments in the City of Stamford.
