The above-captioned matter was heard as contested case on February 17, 2012, at which time the complainant and the respondents appeared and presented testimony and argument on the complaint. The complainant, who is incarcerated, appeared via teleconference, pursuant to the January 2004 memorandum of understanding between the Commission and the Department of Correction.  See Docket No. CV 03-0826293, Anthony Sinchak v. FOIC et al, Superior Court, J.D. of Hartford at Hartford, Corrected Order dated January 27, 2004 (Sheldon, J.). 
The complainant requested all records in his case file relating to his arrest on or about December 18, 1997. Based upon representations of counsel, it was established that the respondents had performed two diligent physical searches of the relevant shelves and determined that they did not maintain the requested records. The respondents agreed to ask the office of the State’s Attorney, Judicial District of Fairfield, whether they maintained the relevant case file and to inform the complainant in writing of the response to their inquiry. Based upon these facts, the complainant stated that he wished to withdraw his complaint.
The Commission recommends the following orders on the basis of the record:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission commends the parties on having reached a settlement.
