Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Twelve appellants were present, three appellant failed to appear. The State Issuing Authority and eight local Issuing Authorities were present, one failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Ms. Gudrun Johnson, Mr. M. Peter Kuck, Ms. Carolyn Futtner, Esq. and Chief Carl Rosensweig

Board Members Absent:  Dr. William Sledge

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Fifteen cases were heard in the following order:

1) Case No. 17-029-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph Sherman represented the appellant. Sgt. Francis Monahan represented the local Issuing Authority, Chief Vernon Riddick, Waterbury Police Department.

Continue: The Board voted to continue this case until March 8, 2018

2) Case No. 16-551-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

3) Case No. 17-160-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Christian Lindstrom represented the local Issuing Authority, Chief Timothy Edwards, South Windsor Police Department.

Withdrawal: The appellant withdrew his appeal.

4) Case No. 17-080-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Katherine Massicotte represented the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department.

Withdrawal: The appellant withdrew his appeal.

5) Case No. 17-189-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Clifford Comerford represented the appellant. Sgt. Francis Monahan represented the local Issuing Authority, Chief Vernon Riddick, Waterbury Police Department.

6) Case No. 17-213-D,, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Captain Thomas LaPore represented the local Issuing Authority, Chief Kevin Searles, Windsor Police Department.

Withdrawal: The appellant withdrew his appeal.

7) Case No. 16-483-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

8) Case No. 16-503-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Col. Kyle Overturf made a motion for the state Issuing Authority by default due to the Appellant failure to appear, seconded by Board Member Kuck. Motion carried unanimously.

9) Case No. 16-486-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Col. Kyle Overturf made a motion for the state Issuing Authority by default due to the Appellant failure to appear, seconded by Board Member Johnson. Motion carried unanimously.

10) Case No. 15-359-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Col. Kyle Overturf made a motion for the state Issuing Authority by default due to the Appellant failure to appear, seconded by Board Member Kuck. Motion carried unanimously.

Chief Rosensweig stepped away from the meeting.

11) Case No. 17-113-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Hector Cardona represented the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department with one witness.

Decision: By unanimous vote the Board voted in favor of the appellant and ordered Meriden Police to issue the permit.

Chief Rosensweig abstained from the vote on Case #11 17-113-D.

12) Case No. 17-069-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  A representative failed to appear for the local Issuing Authority, First Selectman Patricia DelMonaco, Town of New Fairfield.

Motion: Board member Kuck made a motion for the appellant due to the local Issuing Authority, Town of New Fairfield, failure to appear, seconded by Board Secretary Overturf. Motion carried unanimously.

13) Case No. 15-346-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

14) Case No. 17-238-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. Heather Desmond represented the local Issuing Authority, Chief William McKenna, Middletown Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

15) Case No. 17-165-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. McGlynn represented the local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Decision: By a majority vote, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit. Chairman Blando, Attorney Futtner, Board Secretary Overturf voted against the appellant and Board member Kuck and Ms. Johnson voted for the appellant.

Secretary’s Report:

Board member Col. Overturf made a motion to accept the December 14, 2017 minutes as submitted, Attorney Futtner seconded the motion, motion carried.

Adjournment: Board member Col. Overturf made a motion to adjourn, Board Member Kuck seconded the motion, motion carried. Meeting ended at 2:10pm.
