Attorney General Applauds Court Decision Allowing State To Collect About $6 Million In Unclaimed Bottle Deposits
May 6, 2009
"I am pleased that the court agreed with our argument and denied the bottlers' injunction request, allowing the cash-strapped state to begin collecting about $6 million in unclaimed bottle deposits tomorrow and millions more in the future. The statute enabling collection of these funds is clearly valid and enforceable. The court has strongly and firmly sided with our argument that there are no legal grounds to stop this $6 million payment tomorrow. These unclaimed deposits now sitting in distributor bank accounts truly belong to consumers and taxpayers, not to the companies. These deposits will provide much-needed revenue as the state struggles to overcome its current budget crisis.
"I will continue to aggressively contest in court attempts to block state collection of unredeemed bottle deposits, fighting for full and final victory."
