Licensed Environmental Professional Program
An Environmental Program Fact Sheet

NOTE: This is a licensing program for environmental professionals. The first roster of licensed environmental professionals was filed with the CT Secretary of State on August 25, 1997; the roster is updated after the administration of each examination.
 

Purpose

Section 22a-133v of the Connecticut General Statutes (CGS) established a licensing program for environmental professionals with the intent of facilitating the remediation of contaminated sites in Connecticut.

Program Overview

An eleven-member State Board of Examiners of Environmental Professionals administers the licensing program with support from the Department of Energy & Environmental Protection. Only those professionals wishing to engage in the business of verifying clean-ups pursuant to CGS section 22a-134a and/or conducting and verifying clean-ups pursuant to CGS sections 22a-133x and 22a-133y are required to obtain a license.

Applicability under the Property Transfer Program and Voluntary Remediation Programs

CGS section 22a-134a gives the Commissioner discretion to allow licensed environmental professionals (LEPs) to investigate and remediate contaminated sites that are defined as “establishments” by CGS section 22a-134.

As of October 1, 2009, the Voluntary Remediation Program under CGS section 22a-133x may be used by any person for any site. Unless the Commissioner determines otherwise, a LEP may investigate and remediate contaminated sites in this program and verify that a parcel has been investigated in accordance with prevailing standards and guidelines and remediated in accordance with the Remediation Standard Regulations.

The license is not required for those environmental professionals engaged in the business of providing other environmental consulting services relating to the investigation and remediation of other contaminated sites, except as specified in CGS section 22a-133y.

Who is Eligible to Obtain a License?

The Board shall authorize that a license be issued to any environmental professional who meets the following criteria and demonstrates to the Board that such person:

  1. (A) has for a minimum of 8 years engaged in the investigation and remediation of releases of hazardous waste or petroleum products into soil or groundwater, including a minimum of 4 years in responsible charge of the investigation and remediation of the release(s) of hazardous waste or petroleum products into soil or groundwater, AND holds a Bachelor’s or advanced degree from an accredited college or university in a related science or related engineering field or is a professional engineer licensed in accordance with CGS Chapter 391; OR
    (B) has for a minimum of 14 years engaged in the investigation and remediation of releases of hazardous waste or petroleum products into soil or groundwater, including a minimum of 7 years in responsible charge of the investigation and remediation of hazardous waste or petroleum products into soil or groundwater;
  2. AND has successfully passed a written examination or a written and oral examination, prescribed by the Board and approved by the Commissioner, which shall test the applicant’s knowledge of the physical and environmental sciences applicable to an investigation of a polluted site and remediation conducted in accordance with regulations adopted by the Commissioner under CGS section 22a-133k and any other applicable guidelines or regulations as may be adopted by the Commissioner;
  3. AND has paid an examination fee of $235.00 to the Commissioner.
